ODON ORDINANCE #9-962

ORDINANCE PROHIBITING ABANDONED OR UNLICENSED MOTOR VEHICLES FROM THE PUBLIC STREETS AND ALLEYWAYS OF THE TOWN OF ODON

 

WHEREAS, the parking of abandoned and/or unlicensed motor vehicles upon the public streets and alleyways of the Town of Odon was previously regulated and prohibited under Ordinance 100 passed by the Town Board of Odon on the 9th day of December 1969; and

WHEREAS, it has become necessary to revise said Ordinance, it being in the best interest of clarity that said Ordinance 100 shall be superseded by this Ordinance; and

WHEREAS, the Town Board considers the unlicensed and/or abandoned vehicles upon the public streets and alleyways of the Town of Odon to be a continuing problem requiring regulation and prohibition as hereinafter set forth;

NOW, THEREFORE, BE IT ORDAINED AS FOLLOWS:

Section 1 That it shall be illegal for any individual's), corporation or other entity to park, cause to be parked or otherwise located on any public street or alleyway in the corporate boundaries of the Town of Odon any vehicle which does not have a valid Indiana license plate, is unused, abandoned or otherwise a non‑functioning motorized vehicle (or any part thereof).

Section 2 That the Odon Town Marshal or his designate shall place upon any such vehicle as described in Section 1 a notice to the owner to remove same within seven (7) days from the date of said notice placed in, on or around the vehicle in a manner which shall cause said notice to be as secure as possible under the circumstances. If the Odon Town Marshal or his designate, he, she can ascertain the identity of the owner, they or it shall be personally notified in any appropriate manner to remove said vehicle from the public street or alleyway.

Section 3 If the owner or responsible individual's) does not comply with the notice to remove said vehicle as described in Section 1 of this Ordinance, the Town shall cause said vehicle to be removed and any expenses incurred by the said Town of Odon shall be reimbursed by the owner or responsible individual together with the fine as hereinafter set forth.

Section 4 That any individual's), corporation or other entity who does not comply with the provisions of this Ordinance shall be deemed to have committed a Class C infraction and may be fined by a Court of competent jurisdiction in any amount not to exceed Five Hundred Dollars ($500.00) and be responsible for any expenses incurred by the Town of Odon in removing any vehicle as described in Section 1 of this Ordinance, court costs and legal fees incurred by the Town of Odon resulting in the enforcement of this Ordinance.

Section 5 This Ordinance shall be in full force and effect from and after its passage by the Board of Trustees of the Town of Odon, and the publication of said Ordinance as required by the statutes of the State of Indiana.
