DRUG FREE WORKPLACE POLICY

 

The purpose of this policy is to promote and maintain a drug-free work place within the Town of Odon and with its employees.

    1. Manufacture, distribution, dispensation, possession, or use of a controlled substance or drug in the work place is prohibited, whether or not an employee of the Town of Odon is on duty.

    2. Upon conviction of a drug statute violation arising out of conduct occurring in the workplace, employee must notify the President of the Town of Odon no later than five (5) days after a conviction of said violation.

    3. Any employee who learns of another employee's violation of this policy, or of any employee's conviction of a drug statute violation for conduct occurring in the work place shall immediately notify the President of the Town of Odon.

    4. All employees must abide by these rules and observance of said rules are a condition of employment with the Town of Odon.

    5. Any employee who violates any of the above stated rules shall be subject to disciplinary action up to and including termination.

    6. Each employee shall be required to sign and date a statement, which acknowledges and accepts this policy.

    7. For purposes of this policy, "Drug" shall also include alcoholic beverages.

It is the Town of Odon's desire to provide a drug-free, healthful, and safe workplace. To promote this goal, employees are required to report to work in appropriate mental and physical condition to perform their jobs in a satisfactory manner.

While on the Town of Odon's premises and while conducting business-related activities off the Town of Odon's premises, no employees may use, possess, distribute, sell, or be under the influence of alcohol or illegal drugs. The legal use of prescribed drugs is permitted on the job only if it does not impair an employee's ability to perform the essential functions of the job effectively arid in a safe manner that does not endanger other individuals in the workplace.

Violations of this policy may lead to disciplinary action, up to and including immediate termination of employment, and/or required participation in a substance abuse rehabilitation or treatment program, Such violations ,may also have legal consequences.

Under the Drug-Free Workplace Act, an employee who performs work for a government contract or grant must notify the Town of Odon of a criminal conviction for drug-related activity occurring in the workplace. The report must be made within five (5) days of the conviction.

CERTIFICATION OF ADOPTION:

It is hereby certified that the Town Council of Odon, Indiana passed this Drug-Free Workplace Policy, at its legally convened meeting on 1-13-2000.
