PUBLIC
STREETS AND SIDEWALKS
1. Removal
of Dirt. Etc.
from sidewalks, Duty of Abutting Property Owners.
In
order to protect and govern the use of public sidewalks, all owners of real
property abutting upon any street upon which there are located improved
sidewalks are hereby required to keep and maintain such sidewalks in front of
their respective properties clean and free from earth, dirt, rubbish, materials,
debris or other obstructions which may accumulate thereon.
2.
Goods. Wares, Personal Property
on Sidewalks. Streets.
In
order to protect and govern the use of public sidewalks, streets and alleys, it
shall be unlawful for any person, firm or corporation or any person in charge or
having control of the personal property of any person, firm or corporation, to
place any goods, wares, merchandise, signs or other personal property on any
street or sidewalk or alley of the city, for exhibit, storage, sale or for any
other purpose without first obtaining approval from the Odon Town Council. The
above section of this Code shall not apply to the parking of trucks or
automobiles not for sale, properly and legally parked along streets, nor to any
act performed under order of Court.
3.
Authority to Issue Citations.
Any
member of the police or street department of the Town of Odon shall have the
authority to cite a person, firm or corporation for a violation of this
Ordinance.
4.
One Violation/24 Hour Period.
Only
one violation per location may be cited in any 24‑hour period.
5.
Maximum Penalty/Fine.
Any
individual, business or entity who violates the provisions of this Ordinance
shall be fined in an amount not to exceed Two Thousand Five Hundred Dollars
($2,500.00) for each act which may occur contrary to the dictates of the
Ordinance heretofore set forth.
6.
Citations:
All
citations for a violation of this Ordinance shall:
(a)
specify
the violation, the date and time of the violation and the location of the
violation;
(b) state the date, time and location of the hearing
and said violation;
(c) that should said person, firm or corporation fail to appear at the
hearing, the same shall be heard and determined in their absence.
Clerk/Collection
of Pines.
The
Clerk of the Town of Odon is hereby authorized to collect all fines imposed for
a violation of this Ordinance and distribute said funds according to statute.
8.
Enforcement.
This
Ordinance shall be in full force and effect after the passage by the Town Board
and the publication of said Ordinance for three (3) consecutive weeks in the
Odon Journal as prescribed by the Statutes of the State of Indiana regarding
penalty statutes.

OF ODON TOWN ORDINANCE #1350 THOUGH
1.
The Odon Town Board, in accordance with the provisions of I.C. 36-1-6-9 may
enforce Odon Ordinance #1350 through administrative proceedings.
